Institute/Instructor terms
When you sign up as a tutor of an instructor/institute, you are hereby acknowledging and abiding to the terms and conditions set forth by Tecsco Learning Pvt.Ltd on its website instutz.com.
· There is no any partnership, joint venture, employment, agency or contractor relationship between us.
· Instructors/Institute will not be having any direct contractual relationship with the students and whatever the data provided to them by the website should not be utilized in any other activities other than offering services to the students and should not be using the data outside of the website.
· In order to have your payments in timely manner you as an instructor/institute should have a bank account and provide the details of the same and other tax information i.e., PAN & GSTIN details and you are agreeing to that we reserve the right to withhold appropriate taxes arising from the transaction.
· If you have relied on our financial aid in registering your institute under GST and proprietorship with MCA you are hereby agreeing for keeping your content on our website instutz.com for at least 36 months from time when your course goes live on our website.
· You as an instructor/institute should be responsible for all the content which you post on the website instutz.com in the form of videos, reading material, quizzes, exercises, resources, practice tests, instructions on the course page along with the accurate information of your account, credentials, expertise and qualifications, education to teach the content in your videos.
· You should have the necessary licenses, ownership, rights, and consents of content which you publish on the instutz.com website so that instutz.com will be able to use and market the content accordingly. There should not be any infringement of any other party’s intellectual property rights and other copy rights and trademarks.
· Instutz.com will not be responsible for obtaining any licenses from third party for your content and will not be responsible for any royalties originating from the content/activity of the instructor/institute and instructor/institute should ensure the same.
· As an instructor you should be responsible in maintaining quality of the service you are providing to the students so that you will be able to compete with other instructors/institutes on the website. You should also promptly respond to the students in order to maintain high quality standards.
· You should completely avoid posting any inappropriate, derogatory, inflammatory, pornographic, sexist, hateful racist, caste and religion chauvinistic information in your content. Avoid all forms of libelous content and information.
· Instructor/Institute should not frame or embed the services, such as to embed a free version of course, or otherwise circumvent the services. You can only be able do it on the description page of your course.
· You should not gain unauthorized access to another person’s account and interfere with another instructor/institute or prevent them from offering their services. You should not be impersonating as someone else on your account.
· You have the right full ownership of the content you post on instutz.com website and you are allowing instutz.com to reuse, market, advertise, share, modify (adding subtitles to ensure accessibility) ,offer the posted content and sublicense it to the students directly through the instutz.com website or through third parties, without you losing any ownership of the content.
· You have the right remove any portion or all the posted content on the instutz.com website and terminate your services at any point of time. However, the students who are enrolled into your course after payment have the right to access your course till the course time period. Your content will not be visible to new students who wish to find your course from the day when you decide to terminate the course.
· You are also agreeing that we have the right remove your courses and stop the payouts without any prior notice at our sole discretion including when you or your course doesn’t comply with our terms and policy, your course is not maintaining the quality standards, instances where you put instutz.com reputation in public dispute or scandal, engaging with third party services on our website which violates our terms and policy.
· As an Instructors/Institute you agreeing to the terms that tecsco learning pvt ltd will not be responsible for any sort of engagement you initiate with fellow instructor/institute or with fellow students outside instutz.com website, whether on personal basis or any engagement through any other online medium.
· As an instructor/institute you should not engage in practices to manipulate or influence the review system which includes indicating the type of review or rating a student should give, not indulging in the activities like purchasing the reviews, generating reviews from bots or spamming the reviews from the same user, should not try to reward positive reviews from students with discounts or incentives. All the aforementioned actions will be considered as Trust Policy violations of Tecsco Learning Pvt.Ltd.
· The instructor/institute decides the price of each and every course in the account of instructor/institute while publishing the content and will completely abide by the revenue sharing principle of the Tecsco Learning Pvt.Ltd. Tecsco Learning Pvt Ltd has the right to change it revenue sharing methodology whenever deemed necessary and instructor/institute will be promptly informed prior to the change.
· The price which is displayed on the website to the student includes the all the taxes including GST. We will hold your GST amount and the TDS amount on the transactions made before the money is delivered into your account while we retain our commission on the transaction.
· In order to have your payments in timely manner you as an instructor/institute should have a bank account and provide the details of the same and other tax information i.e., PAN & GSTIN details and you are agreeing to that we reserve the right to withhold appropriate taxes arising from the transaction.
· Revenue generated from the transactions in a particular month will be paid to you at the end of the month 7 days after we receive the payment of the transaction happened on a particular course. Instructors/institutes are responsible for determining the price of each and every course which you have uploaded. Instructors/institutes are also responsible for the discounts provided for their courses. Instructors/Institutes are agreeing to the condition that for the transactions happening on the price of their respective courses on instutz website only the percentage of the transaction agreed on while enrolling will be delivered as commission to their respective accounts at the end of the month after 7 days after the transaction occurrence.
· In certain peculiar cases where the refund to a student on a particular transaction is enabled, you agree to the terms that no amount will be paid to you on that particular transaction and Tecsco Learning Pvt Ltd has right to withhold that transaction payment from you.
· We offer a set of APIs for improving the quality of the course for the institutes and by accessing them you and the institute you represent are agreeing to the terms.
· At any point in the future we reserve the right to charge the APIs we provide, cease to offer the APIs, modify them and require you to use the subsequent versions of the APIs and in a different manner. If we determine that you are using APIs is against the interests of us or our users we reserve the right to block your credentials.
· You are agreeing to indemnify and protect us at your expense against any third party claims, losses, infringements, demands, expenses, damages which can arise from violation of terms and conditions, any privacy laws and regulations, violation of rights of any third party.
· In no event either party involved shall be responsible for any indirect punitive and consequential damages including lost business opportunities and profits.
· We reserve right to monitor your use of API to ensure quality, improve the quality of our products and services and to verify your compliance with the terms.
· You should not collect and share instutz account passwords. You should not also copy, reformat, reverse engineer or otherwise modify any instutz.com’s product or service and other APIs. You should not combine or enrich any personal data with data obtained through third party sources.
· You should also not create any app that recreates the core functionality of or replaces instutz’s product and services that is likely to cost us reputational and financial damage. You should also not engage in any deceptive, illegal, unethical, misleading activities which can be detrimental to instutz, APIs, our users or the general public.
· You must also delete all the content on our website and APIs if we terminate your use in case of violating any terms or laws.
· There may be updates in terms from time to time and your continuity of our services shall mean your acceptance of those updated terms. We reserve the right solely, to modify/update the terms at any point of time and we will notify the same to the instructor/institute. Any updated/modified terms will be effective from the day are posted and will revised terms will supersede all previous terms.
